Welcome to Farmers Fresh. These Terms and Conditions ("Terms") govern your use of the Farmers Fresh mobile application ("App") and website www.farmers-fresh.com ("Site"), operated by Farmers Fresh.
By downloading, accessing, or using our App or Site, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access our App or Site.

- "Products" refers to the fresh produce and other items available for purchase through our Service.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

When using our Service, you agree not to:
- Use the Service in any way that violates any applicable local, state, national, or international law or regulation
- Impersonate or attempt to impersonate Farmers Fresh, a Farmers Fresh employee, another user, or any other person
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
- Use the Service for any purpose that is unlawful or prohibited by these Terms
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service
- Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose
- Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful
5. Ordering and Payments
5.1 Ordering
- You can place orders for Products through our App.
- We reserve the right to refuse or cancel your order at any time for reasons including but not limited to product availability, errors in product or pricing information, or problems identified by our fraud and verification team.
5.2 Payments
- We use Razorpay as our payment processor. Your use of Razorpay's services is subject to Razorpay's terms and conditions.
- You agree to provide current, complete, and accurate purchase and account information for all purchases made via the App.
- You agree to promptly update your account and payment information, including email address, payment method, and payment card expiration date, so we can complete your transactions and contact you as needed.
6. Delivery
6.1 Delivery Areas
- We currently offer delivery services only in selected pincode areas.
- You understand that our delivery area may change without prior notice.
6.2 Delivery Times
- We will make reasonable efforts to deliver Products within the estimated delivery timeframe provided at checkout.
- Delivery times are estimates only and are not guaranteed.
- You agree that we are not liable for any delays in delivery caused by circumstances beyond our control.
7. Cancellations and Refunds
7.1 Order Cancellation
- You may cancel an order as per our cancellation policy, which may vary based on the order status.
- We reserve the right to refuse cancellation requests if the order preparation or delivery process has already begun.
- Cancellation policies will be clearly stated during the checkout process.
7.2 Refunds
- Refunds will be processed according to our refund policy.
- If you receive damaged or defective Products, you must notify us within 24 hours of delivery to be eligible for a refund or replacement.
- Refunds will be credited back to the original payment method used during purchase.
- Processing of refunds may take 5-7 business days, depending on your payment provider.

- You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App or Site.
- The Farmers Fresh name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Farmers Fresh. You may not use such marks without our prior written permission.
10. User Content
- You retain ownership of any content you submit to our Service ("User Content").
- By submitting User Content, you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, modify, and distribute your User Content in connection with the operation of the Service.
- You represent and warrant that you own or control all rights in and to your User Content and that your User Content does not violate these Terms or any applicable law.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FARMERS FRESH, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. FARMERS FRESH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Indemnification
You agree to defend, indemnify, and hold harmless Farmers Fresh, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the App.
15. Changes to Terms
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
16. Governing Law
These Terms and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
17. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiations. If such dispute cannot be resolved through negotiations, it shall be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
19. Waiver
No waiver by Farmers Fresh of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
20. Entire Agreement
These Terms, our Privacy Policy, and any other terms and conditions referenced herein constitute the sole and entire agreement between you and Farmers Fresh regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
